You didn't say if you sustained any damage. If you did, you might
approach the contractor and ask for reimbursement, if he's a stand up
guy he should take care of it, or his insurance should. Or you could
wrap a note around the rock and leave it on the front seat of his
vehicle, if there's one there. Opening the door is optional...
Road hazards are just that...just a few months ago I was following
my wife on her nice shiny '40 Indian scout just after dark when she hit
a softball sized rock in the road from someone's driveway. Lots of
sparks and tank slapping, to her credit she kept it up but had to change
her panties. Suprisingly there was no damage, we kept going.

My question is, do I have a legitimate negligence complaint against the contractor? I feel like it was totally not my fault for hitting the rock and that the contractor was negligent in the maintenance of the fence to proper standards. Would like to hear some opinions and see if anyone else has had a similar experience. |
