I'm no lawyer, but I know how you feel. I work hard to have my stuff and
work hard to keep it in good condition. Within the first month of driving
the first brand new truck I got 3 chips in the windshield due to the dirty
construction trucks hauling down the road. I was pissed and still am.
There's only so much you can due though. Usually just bitch. sh*t happens.
There are roads here in Detroit that are just so bad I don't go down
'em(Lodge freeway for one)If the bumps make my truck fly in the air I can't
imagine what kind of hell it would put the bike through. So I wait in
traffic like every other A-hole instead of taking the shorter way home from
work.
Pisses me off even more that people don't think about motorcycles and what
affect their actions or inactions could have on a rider, i.e. bad roads,
debris in the road. There was one time I was on the I-75 service drive at
night. At the last second an open sewer appeared ahead of me, in a turn
yet!. Yup, just a big hole, someone either stole the steel cover or the
workers forgot to put it on. I was able to swerve out of the way but the
thought of my front wheel falling into that at 40 mph gave me the shivers.
If I hit that, and lived, I would probably be a rich man right now.
It sounds like it might be a frivolous suit at first but if you got the time
to pursue it, talk to a lawyer. Would I? eh, all depends on what's going on
in my life, It seems I'm always fighting with someone, phone co, bank,
someone! Because of someone not doing their job, your sh*t got f*cked up.
Too many people just sit back and take it.

I have a question. Wednesday, I put new tires on my car
(Yokohama Avid Touring...great tires and affordable too).
Thursday evening going home after work, I hit a softball
sized rock in the road by a new construction in my
neighborhood. It was about a foot into the roadway and
somewhat obscured by debris and weeds growing there.
There was a silt fence there that was mostly torn down.
If it had been up properly, I am sure the rock would have
never made it into the road from the hill of the property.
My question is, do I have a legitimate negligence
complaint against the contractor? I feel like it was
totally not my fault for hitting the rock and that the
contractor was negligent in the maintenance of the fence
to proper standards. Would like to hear some opinions and
see if anyone else has had a similar experience.
